1. Who you are agreeing with

Virtual CareGiver is operated by Clyde Tressler, a sole proprietorship located in New York, at VirtualCaregiver.com, 4867 Broadway, PMB 1002, New York, NY 10034. In these terms, “we,” “us,” and “Virtual CareGiver” mean that seller; “you” means the person buying or using the product.

2. What Virtual CareGiver is — and what it is not

Virtual CareGiver is a reminder and orientation aid. It shows information that you, the caregiver, write and approve, on a screen in another person’s room.

It is not a medical device. It is not FDA-regulated, it is not a monitoring or alerting system, it does not detect falls, emergencies, or changes in health, and nobody is watching it on your behalf. It must not be used as a substitute for professional medical care, in-person supervision, or emergency services. It does not calculate medication doses or schedules — it repeats, word for word, what you typed.

You are responsible for the content you put on the display, including anything drafted for you by the AI feature and approved by you. You are responsible for confirming that what you approved is correct before it reaches the display.

Do not rely on Virtual CareGiver for anything time-critical or safety-critical. The display is a small computer connected to home Wi-Fi and mains power. It can be unplugged, lose its network, lose power, or fail. If someone’s wellbeing depends on a reminder arriving, that reminder needs a human being behind it, not a screen.

3. Early access

Virtual CareGiver is currently sold in early access. That means:

  • The product works as described on our website, and it is actively being improved. Features may change, be added, or occasionally be removed if a better approach replaces them.
  • We tell you about the limitations we know about. The one that matters today: after the AI drafts your slides, glance at the Schedule view to confirm the days and times, because the AI occasionally places a reminder on the wrong day and that glance catches it.
  • Software improvements are included at no additional cost, for as long as you own the device.

4. What you are buying

  • Pre-assembled unit ($225 plus shipping) — a Virtual CareGiver Display Driver: a compact computer with the software pre-installed, a power supply, an HDMI cable, and a printed quick-start guide.

A screen is not included with the unit, on purpose. You supply the TV or monitor. We do not sell displays.

Prices are in US dollars. We currently ship within the United States only.

5. Ordering, availability and delivery

Each unit is assembled to order. The lead time stated at checkout is our good-faith estimate. If we cannot ship within the time stated, we will email you before we ship, and you may cancel for a full refund.

Placing an order does not create a contract until we accept it. We may decline or cancel an order and refund you in full — for example if we are out of stock, if the address cannot be shipped to, or if we suspect fraud.

6. The software, and what you may do with it

The software on the device and in the web app is licensed, not sold. Buying a device gives you a personal, non-exclusive, non-transferable licence to use that software on that device, for its intended purpose. It is not open-source.

You may not copy, redistribute, resell, publish, decompile, or reverse-engineer the software, or remove or alter its notices, except where that restriction is not permitted by law. You may resell or give away the physical device; the licence travels with it to the new owner on the same terms.

Nothing here restricts your own content. Your reminders and schedules are yours. They live in your own Google account and we claim no ownership of them.

7. Your Google account

Setting the product up requires you to sign in with Google and grant access limited to the files the app creates for your display (Google’s drive.file scope). We use that access only to create and update your display’s content. You can revoke it at any time from your Google account settings; if you do, the display will stop receiving updates and will eventually ask to be paired again.

Your use of Google’s services is governed by Google’s own terms.

8. The AI drafting feature

The AI drafting feature is optional. Everything the product does can be done without it, using the fill-in-the-blank templates, and that path is free and complete.

  • New accounts receive a starting allowance of 50 AI drafting credits at no charge.
  • When the allowance runs out, AI drafting stops and the rest of the product continues to work normally, at no additional cost, forever. Nothing is disabled, nothing is held hostage.
  • Additional credits may be offered for purchase in future.
  • Drafts are generated by a third-party AI service from the description you type. Drafts are suggestions. You review and approve every slide before it reaches the display, and you are responsible for what you approve.
  • AI output can be wrong. See §3.

9. Optional care service

No subscription is required to use Virtual CareGiver. We may later offer an optional annual care service covering additional AI drafting, priority support, and similar. It would be optional, and the device you bought does not depend on it. If you never subscribe, or subscribe and later stop, your device continues to work exactly as it did — it reads your content from your own Google account and does not need our permission to keep running.

10. Support

We provide support by email at support@virtual-caregiver.com. During early access we aim to answer within one business day. This is a best-efforts commitment, not a service-level guarantee.

We cannot log into your device remotely. The device makes outbound connections only; there is no remote-access path into a customer’s home. If a problem needs more than email, we will arrange a call or ship you a replacement card.

11. 90-Day Limited Warranty

Who gives this warranty. Clyde Tressler, trading as Virtual CareGiver, VirtualCaregiver.com, 4867 Broadway, PMB 1002, New York, NY 10034 — support@virtual-caregiver.com.

Who this warranty covers. The original purchaser of the product.

Not to be confused with §6: the software licence does travel with the device to a new owner. The licence and this warranty are separate things, and only the licence transfers.

What is covered, and for how long. We warrant the physical hardware against defects in materials and workmanship for 90 days from the date of delivery.

What we will do, and at whose expense. If the hardware fails within those 90 days through no fault of yours, we will repair it, replace it, or refund it, at our option. We pay the shipping in both directions on a warranty claim — you are not charged to receive replacement hardware, and the label to send the faulty hardware back is prepaid and comes in the box.

What is not covered. This Limited Warranty does not cover accidental damage, liquid damage, power surges, modification, or ordinary wear on the SD card. It covers the physical hardware only: the software is licensed under §6 and is not covered by this Limited Warranty. Our commitment for the software is the one made in §3 — it works as described on our website, and improvements are included at no additional cost for as long as you own the device.

How to make a claim.

1. Email support@virtual-caregiver.com within the 90 days and tell us what the display is doing. Your order number helps; your name is enough.

2. We reply — during early access, we aim to do that within one business day — and help you rule out the things that are not hardware faults, such as the network or the TV’s input setting.

3. If it is a hardware fault, we send a replacement SD card first, at our expense. That fixes most problems.

4. If the replacement card does not fix it, we replace the unit or refund it, at our option, also at our expense. We ship the replacement unit straight away — you do not have to send the faulty one back first, and you are not left without a display while it is in the post. A prepaid return label comes with it.

5. Please send the faulty unit back within 30 days of your replacement arriving. If it has not reached us by then, we will email you an invoice for the replacement unit at its purchase price — we will never charge your card without telling you. Post it back and the invoice goes away.

ANY IMPLIED WARRANTIES ON THIS PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO 90 DAYS FROM THE DATE OF DELIVERY.

Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to Virtual CareGiver is limited to the amount you paid us for the product. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of profits, or any harm arising from a reminder that was not shown, was shown late, or was shown incorrectly.

Nothing in these terms excludes or limits our liability for death or personal injury caused by a defect in the product or by our negligence, for gross negligence, willful misconduct, or fraud, or for anything else that applicable law does not allow us to exclude or limit. Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of this section may not apply to you.

Each part of this section applies separately. If any part of it is found unenforceable, the other parts still apply to the fullest extent permitted by law.

13. Acceptable use

Do not use Virtual CareGiver to display content that is unlawful, that harasses or deceives the person viewing it, or that you do not have the right to display. Do not use it to surveil anyone — it has no camera or microphone, and we will not build one in.

14. Changes to these terms

We may update these terms. If a change materially affects you, we will email the address on your order. Changes are not retroactive, and we will not use a terms change to take away something you already paid for.

15. Termination

You may stop using the product at any time; the device is yours. We may suspend access to the web app if it is being used in breach of §13, or to prevent abuse or fraud. Suspension of the web app does not brick your device — it keeps rendering the content already in your Google account.

16. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
